Asterix & Friends Sproing Publishing GmbH

Sproing Publishing GmbH (hereinafter referred to as Sproing Publishing), Fernkorngasse 10, 1100 Vienna is publisher of the game “Asterix & Friends”. These terms of Service define the service agreement relationship between the User and Sproing Publishing. Unless otherwise stipulated by a separate arrangement or by the present Terms of Service, the General Terms and Conditions for Games, Video and Music remain effective. Sproing Publishing is not able to make sure, that all services can run undisturbed in full extent during the whole contract-period.

Right to use
Any communication or material the User of the service, send to Sproing Publishing or post on the website by electronic mail or otherwise, including any data, questions, comments, suggestions, is and will be treated as non-confidential and non-proprietary. Anything the User transmit or post may be used by Sproing Publishing and/ or Les Éditions Albert René, 26 avenue Victor Hugo, 75116 Paris (France) (hereinafter referred to as LEAR) for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast, and posting. Sproing Publishing may, in its sole discretion, remove or edit any content that seems to be illegal or in violation of acceptable moral standards or otherwise in violation of these Terms of Service. The User shall observe national and international copyrights, trademark, patent and name rights, as well as other industrial and personal rights of Sproing Publishing, LEAR and any other third parties. In the event of a breach of these Terms of service Sproing Publishing reserves the right to bar access to the service.

Furthermore, Sproing Publishing and/or LEAR are free to use any ideas, concepts, know-how, or techniques contained in any communication the User sends to Sproing Publishing or posts on the Site for any purpose whatsoever including, but not limited to, developing, manufacturing, and marketing products using such information, without obtaining the User’s permission and without any compensation to the User.

Finally, the User recognizes that LEAR is the owner of the username that was assigned for the usage of the Asterix & Friends browser game and LEAR can use it for the designation of new characters and contents in all products of the Asterix franchise without any restrictions, User’s permission, and without any compensation to the User.

Furthermore the User accepts the Asterix licence code of practice:
General interdictions
• The Asterix brand and characters shall not be associated with the following products: Tobacco, Alcohol, Gambling, Politics, Sex, Drugs, Medicines or Stimulants of any kind.
• When the characters are taken out of the context of the albums, they are to maintain their own character. This means that they do not talk about money, quote brands, or allude to equipment or situations unfamiliar to the Gaulish era. Therefore all anachronisms shall be avoided.
• The characters shall not, under any circumstances, be associated with people or characters other than those connected to the universe or the Adventures of Asterix the Gaul.
• The characters shall not be directly associated with the products and/or services of the licensee. For example, Obelix shall not carry the product in the way he carries menhirs.
• In exceptional cases, where the characters are to be put in a situation with the actual products, the latter shall appear as a photo and shall not be redrawn.
• The characters “do not speak”: this means that they are not to be shown with a speech balloon unless it features in the album from which the character has been extracted. It is forbidden to change the text in the original balloon.
• Characters are not to be shown with other characters whom they have not met in the albums (with the exception of certain visuals, such as the family photo created by Studio).
• In the event that the text relates directly to the characters, the use of comic lettering is imperative. Depending on the text itself, a speech balloon, yellow flash or a box can be used.
• Using words ending in -ix shall be limited to the proper names of characters from the lists created from the Adventures of Asterix. No creation is permitted.
